CHARGES  

Marijuana.  Heroin.  Cocaine.  Pills.  The drugs are varied but they have one common theme: they can lead to very serious criminal penalties if you are facing a drug related charge in New York.  

 

Defense against drug related charges requires not just any criminal defense attorney.  It is recommended to be represented by an attorney that has experience not only with New York's complex drug laws, but one who also understands the issues surrounding drug use, such as addiction.

 

During a free consultation with our office, an individual charged with a drug related crime can expect to talk about several topics.  For starters, we will need to talk about the arrest and the evidence.  The law provides many tools to defense attorneys to challenge the evidence against you.  Evidence comes in many forms.  Two of the most common forms of evidence include: physical evidence (the drug), and statement evidence ("yes officer, those are my drugs").  We will need to discuss with you how the arresting officer came upon the drugs, and how you came into the position of saying, "yes officer, those are my drugs."  The 4th Amendment to the United States Constitution protects the public against unreasonable search and seizure.  The 5th Amendment gives you the right to remain silent.  Therefore, we will need to make sure that the police did their job correctly.  If they did not, we may be able to challenge the evidence that is presented against you as part of the prosecutor's case.

 

But before we even get that far, we need to understand you and the circumstances that may have led to drug use/possession.  Addiction is a disease at epidemic levels.  Just because someone is arrested for drug charges, does not mean that the person is a bad or evil person.  We understand that good people fall victim to addiction, and that addiction can lead to arrests.  Therefore, we spend the time understanding not just what happened, but why it happened.  We are proud of our service to clients who require drug charge defense because very often we are able to work with the prosecutor and treatment providers to prioritize recovery over punishment.  Fortunately, we have tremendous experience with Drug Court, a great resource that allows defendants the opportunity to commit themselves to treatment and earn a much better case outcome.  However, Drug Court is not a right -- it is a privilege.  Therefore, your attorney will need to convince the prosecutor that you should be given the opportunity to participate in such a program.  This requires great experience -- experience that we have!
