PROXY EXECUTION

A health care proxy is understandably not the most comfortable document to have executed. However, it is still a very important and crucial one that everyone should have. If you are unfamiliar, A health care proxy designates another individual as your “proxy”or “agent” to make health care decisions on your behalf when you are unable to do so yourself. For example, if you are incapacitated, you may not wish to be kept alive via a medical machine if there is no reasonable belief a meaningful recovery can be made. 

 

 

 

In unforeseen circumstances, this document can be extremely valuable as it will ensure your wishes are being followed and your family and friends are guided in such difficult time. Although it may have been voiced at one time or another how treatment should be provided, verbal directives are not sufficient for a hospital or other health care facility to rely upon. A health care proxy MUST exist for your instructions to be followed in a situation where you are unable to communicate your wishes directly. For these unforseen circumstances, many of our clients come to our firm to draft their will, health care proxy, and/or power of attorney. Our process is kept simple and very efficient as you will see below! 

 

 

Our Intake Process:

 

During your first call with our office, you will immediately be taken care of and asked a series of standard intake questions. An appointment will be scheduled based on your availability and you will meet with Attorney David Fried personally. More in-depth questions will be asked of you regarding your health care wishes, potential designated agents, and any other special items you may wish included in your health care proxy. At the conclusion of the meeting a Health Care Proxy Form will be issued to you so as to ensure absolute accuracy of names, phone numbers, specific wishes, etc. 

 

Once the form has been returned to our office, drafting of the health care proxy will commence immediately. You can expect receiving updates and/or inquiries for additional information if needed. Upon completion of the draft, a copy is always provided to the client for their final review. If no alterations or adjustments must be made, a date will be scheduled for execution of the document. 

 

Execution of the Health Care Proxy:

 

At the time of execution, an attorney will always be present. A final review of the health care proxy is done once more with you to ensure absolute accuracy and address any questions / concerns that may be raised. Once we receive your approval, the document is then executed by the client. The original health care proxy is then provided to the client along with courtesy copies for distribution purposes (it is recommended that you provide a copy to your primary health care physician). One copy will always be held with this office for safe keeping. In the event that any changes or updates need to be made in the future, we welcome calls to make those adjustments! It is extremely important that these changes are not made by the client themselves as it can invalidate the entire health care proxy. As you can see, this is a process our office makes extremely easy for our clients!
